"Artichoke" legal address: 13/518 Holosiivska Street, Kyiv, Ukraine, registered in accordance with the laws of Ukraine, hereinafter referred to as the "Seller", offers a public offer contract (hereinafter - the "Agreement") under the following conditions:
  

1 General provisions

1.1. The seller is the owner and operator of the electronic commercial website www.artichoke-official.com (hereinafter - the "Site").

1.2. This Agreement establishes the terms of purchase and sale of goods sold on the Seller's Site.

1.3. Users of the Site (hereinafter referred to as "Buyers") may accept the terms of this Agreement by placing an order on the Site.

 
 

2 Subject of the Agreement

2.1. The Seller undertakes to deliver the goods to the Buyer within the stipulated time and fulfill other conditions, while the Buyer undertakes to pay and accept the goods under the terms of this Agreement.

 

3 Orders

3.1. The order of the product is carried out by the Buyer on the Site by adding the product to the basket and placing the order.

3.2. Confirmation of the order is the receipt by the Buyer of an electronic message confirming the acceptance of the order.

3.3. The buyer undertakes to provide correct and reliable information when placing an order.

4 Price and payment

4.1. The price of goods is indicated on the Site and may be changed by the Seller at any time.

4.2. Payment is made by the Buyer in accordance with the payment method chosen by him, which is provided on the Site. The Seller accepts the following payment methods: credit/debit cards, electronic payment systems and other available methods indicated on the Site.

 

5 Delivery and transfer of goods

5.1. The Seller ensures the delivery of the goods to the Buyer in accordance with the delivery method chosen by him, which is provided on the Site. The cost and delivery time may vary depending on the selected parameters.

5.2. The risk of loss or damage to the goods passes to the Buyer from the moment of handing over the goods.

5.3. The Buyer undertakes to inspect the goods upon receipt and to notify the Seller of any defects or damage.

 

6 Return of goods

6.1. The buyer has the right to return the goods to the seller within 14 (fourteen) days from the day of receipt, provided that the goods have no signs of use, their appearance and consumer properties are preserved, and the packaging and all labels are preserved.

6.2. In case of returning the goods, the Buyer is obliged to inform the Seller about his choice and to fill out a special form for returning the goods, which is provided upon request.

6.3. If the return of the goods meets the conditions stipulated in this Agreement, the Seller undertakes to return the cost of the goods to the Buyer, with the exception of delivery costs.

7 Responsibility

7.1. The Seller is not responsible for damage caused to the Buyer as a result of improper use or improper storage of the goods.

7.2. The Seller shall not be liable for any direct or indirect damages, including loss of profit or loss of data, arising from the use or inability to use the product, even if the Seller has been advised of the possibility of such damages.

7.3. The seller is not responsible for any losses or delays in the fulfillment of obligations in the event of force majeure, including, but not limited to: natural disasters, war, rebellion, acts of terrorism, blockade, epidemics, restrictions on the activities of government agencies and others independent of Seller's circumstances.

 

8 Privacy

8.1. The Seller undertakes to maintain the confidentiality of the information received from the Buyer during the execution and execution of the Agreement, except when the disclosure of such information is necessary for the fulfillment of obligations under this Agreement or is required by law.

 

  9 Changes and additional conditions

9.1. The Seller has the right to make changes to this Agreement unilaterally by posting an updated version on the Site.

9.2. Additional terms and conditions that do not conflict with this Agreement may be defined in separate agreements between the Seller and the Buyer.

10 Final Provisions

10.1. This Agreement is a legal agreement between the Seller and the Buyer and regulates the relationship between them regarding the purchase and sale of goods on the Site.

10.2. In the event that any provision of this Agreement is deemed invalid or unenforceable for certain reasons, this shall not affect the validity or enforceability of other provisions of the Agreement.

10.3. In case of disputes related to this Agreement, the parties undertake to provide each other with a written notice with a detailed description of the nature of the dispute. In case of failure to reach an agreement through negotiations within 30 (thirty) calendar days, the dispute shall be resolved in accordance with the current legislation of Ukraine before a competent court.

This Agreement enters into force from the moment the Buyer accepts the terms of the offer and places an order on the website www.artichoke-official.com
